
1. Description of Services. From here on Logico
Technology, Inc. will be referred to as we ("The Company,
LTI") and you the ("Customer"/"Client/Buyer").
2. Indemnification; Consent. By using this
web site (this "Site"), you agree to the terms and
conditions as well to our privacy policy. You agree to indemnify
and hold Logico Technology, Inc., and its subsidiaries, officers,
employees, affiliates, or partners, harmless from any claim
or demand, from and against all losses, expenses, damages and
costs, including reasonable attorneys' fees, resulting from
any violation of these terms and conditions.
3. Protecting and Securing Customer Transaction Data.
Logico Technology, Inc. is committed to safeguarding customer
information and combating fraud. We have implemented industry
leading security initiatives, and our clients are protected
by the strongest encryption methods and security protocols available.
We use the latest 128-bit Secure Socket Layer (SSL) technology
for secure Internet Protocol (IP) transactions. We employ industry
leading encryption hardware and software methods and security
protocols to protect customer information. Our infrastructure
is compliant with card association security initiatives including
the Visa Cardholder Information Security Program (CISP), MasterCard®
(SDP), and Discover Information Security and Compliance (DISC).
For security purposes we do not store credit card data longer
than 24hrs after your purchase; we delete and purge all credit
card information with in the 24hrs threshold.
4. Payments. We honor varies forms of payments
method such as; major credit cards; (Visa/MasterCard, Amex,
Discover) checks, wire transfers, echecks and pay pal. Our company
does charge a credit card processing fee for wholesale pricing
if payment is made through a credit card.
5. International Clients. In order to transact
business with Logico Technology, Inc. International buyers are
to make payment by wired transfer (T/T), no credit card payments
will be allowed.
6. Changes to Privacy Policy; Terms and Conditions.
Logico Technology, Inc., has the right, in its sole discretion,
to add, remove, modify or otherwise change any part of these
Terms and Conditions, including the Privacy Policy, in whole
or in part, at any time by posting these changes online. You
should visit this page from time to time to review the then-current
Terms because they are binding to you.
7. Shipping Charges. Shipping charges are not
refundable, and shipping will be charged for the new items(s)
sent. OVERNIGHT SHIPPING FOR AMMOUNTS GREATER THAN $ 250.00
MADE THROUGH A CREDIT CARD WILL REQUIRE A TEMPORARY 24HR HOLD
ON SHIPMENT UNTILL OUR SECOND CREDIT CARD VERIFYCATION PROCESS
IS COMPLETE. THIS POLICY ONLY APPLIES TO NEW CUSTOMERS. Alaska
& Hawaii customers are required to contact LTI directly
for shipping estimates before ordering, failure to do so will
result in your order being delayed due to inaccurate shipping
charge. Overnight shipped must be specified at time of ordering
and additional charges will apply; all orders are send via FedEx,
UPS or DHL 3-5 shipping service. LTI's has the right, in its
sole discretion, to modify or otherwise change the carrier/s
which products are shipped by, at time of shipping to allow
logistics deployment coordination.
8. Pricing & Availability. Due to the changing
market conditions, a price list is not published. All quotes
are valid for 5 business days from the date of the quotation
via fax or email.
9. Check Policy. Purchases made through personal
and corporate checks are subject to funds verification availability.
There is a hold on ALL purchases made through personal or corporate
checks until funds are available and credited to Logico Technology's
account. Checks could take up to 3 - 7 working days for local
accounts in the state of California and possibly 10 working
days for out of state checks. Logico Technology will notify
customer via email, phone, or fax stating that merchandise is
ready for shipping to address specify once check has clear.
A fee of $29 will be asses on all return checks whether corporate
or personal.
10. Warranties. Logico Technology, Inc. adheres
to the manufacturers warranty and does not offer warranties
on any of the products sold through its ecommerce store; nor
does LTI Repair, Service or provide Technical Support on any
products sold; for Technical Support, Service, Repair and Warranty
Issues please contact the manufacturer directly. ALL WARRANTIES
ARE OFFER BY THE MANUFACTURER AND ALL PRODUCTS COME WITH EITHER
90 DAYS, 1 YEAR, 2 - 3 YEARS WARRANTY AND LABEL ACCORDINGLY
IN THE DESCRIPTION OF THE PRODUCT. We obtain all of our product
descriptions straight from our Vendors, Partners, and Manufacturers;
and we feel that the information provided to our company is
correct and precise and in no way does LTI alters this information.
THERE ARE NO WARRANTIES ON SERVICES.
11. Violations of Terms. Should you violate these Terms
and Conditions or any other rights of Logico Technology, the
company reserves the right to pursue any and all legal and equitable
remedies against you ("Client"/"Customer/Buyer")
to collect its debt.
12. OEM Software. All software provided is
subject to the license agreement, which is part of the original
software licensing agreement that is shipped from the OEM Manufacturer.
OEM or "bundled" software releases are not offered
with warranty support by Logico Technology. The Customer agrees
that it will be bound by End User License Agreement ("EULA"),
once the package is opened or its seal is broken. All Rights
Belong to the OEM Manufacturer and not Logico Technology. The
company will only accept unopened or pre-installed software
and CD's for return. NO OPEN SOFTWARE WILL BE ACCEPTED.
13. Return Policies. The original invoice is
required and Customers are responsible for shipping charges
and risks involved on return shipments. All product returns
must be processed with a Return Authorization Number (R.A. #).
NO returns, of any type, will be accepted without R.A. #.
R.A.'s issued are valid for 10 days only and product must be
returned to within this timeframe. R.A.'s cannot be extended
or re-issued.
Due to manufacturers' policies we cannot accept returns of the
following items for exchange, replacement or credit for any
reason: Compaq, IBM, Toshiba, and Hewlett Packard. DOA or defective
can be returned for repair only to an authorized service center.
Please have the following information on hand when calling for
R.A. #: customer name, invoice number, serial number and the
nature of the problem. All can be found on your invoice. Please
note that the following products cannot be returned:
- Discontinued items
- Special or Custom order items
- Items for which manufacturers will not accept returns
- Products modified by the Configuration Center/End User
- Open units, units which require re-boxing, or units in an
unsuitable resale condition
- Closeout, remanufactured and refurbished products
- Items which have undergone revisions without being assigned
a new part number by the manufacturer
All returns MUST: be 100% complete, contain ALL original boxes
and packing material, have original UPC codes on the manufacturer's
boxes and contain all blank warranty cards, accessories and
documentation provided by the manufacturer. Incomplete returns
may be returned to sender or subject to a restocking fee up
to 20%.
14. Liability. Logico Technology, inc., in
no event will be liable to any party for any damages including
without limitation, any direct, indirect, special, punitive,
incidental or consequential damages (including, but not limited
to, damages for loss of business profits, business interruption,
loss of programs or information, loss of profits and savings).in
no event does the company accept liability for products not
being available for use, lost or corrupted data or software.
Customer agrees that for any liability related to the purchase
of products or services bundled with the products, Logico Technology
is not liable or responsible for any amount of damages.
15. Links to Third Party Sites. The links on
this site will let you leave Logico Technology's site. We are
not responsible for the content made by third party link sites
and thus releases Logico Technology from any claims of liability
directly or indirectly.
16. Deep Linking. Linking to Logico Technology's
Internet site must only be to the respective home page. No "deep
linking" to other pages to Logico Technology's Internet
sites is permitted without Logico Technology's prior written
consent.
17. Copyright and Trademark Notices. This Web
site is owned and operated by Logico Technology, Inc. Usage
of services, and/or products presented on this site constitutes
the User's agreement to abide by the following terms and conditions
set forth by Logico Technology, Inc. The use of LogicoTechnology.com
and LTI are register trade marks of Logico Technology, Inc.,
and can not be duplicated with out prior written consent to
Logico Technology, Inc., board of directors and subject to approval.
Any duplication of these trademarks imposes infringements of
rights; will result in legal action by Logico Technology, Inc.
18. Privacy Policy. Logico Technology, Inc.
does not sell its customers database or email address to any
second or third party companies. Emails collected by the company
remain sole ownership of Logico Technology, Inc., and are use
for internal marketing purposes only. Emails addresses are not
for sale and Logico Technology respects its customer's privacy.
19. Governing Law. These General Conditions
are governed by, construed and enforced in accordance with the
laws of California. Disputes arising from these General Conditions
are subject to the exclusive jurisdiction of the courts of California.
20. Factory-Reconditioned Products. Customers
return products for many reasons: a customer may change his
or her mind; not like the product or have difficulty operating
it. Whether it is return within a month later or the very next
day, such an item must be identified as "Reconditioned",
"Recertify" or "Refurbished" to be resold.
21. Inspection of Product(s). The buyer shall
inspect the product(s) at delivery and shall notify LTI of any
defects or discrepancies within ONE DAY of receipt of product(s).
Dead On Arrival (DOA) products, buyer is required to contact
LTI for RMA number within 48 hours of receipt date
22. California Recycling Program. A California
statute requires us to assess an electronic waste recycling
fee on purchases of certain electronic products that are shipped
to or picked up at California addresses. The fee is collected
at the point of sale and sent to the State of California in
accordance with statutory requirements. Recycling fees are charged
on all computer monitors (CRT and LCD), CRT televisions, laptop
computers and other CRT-based devices. Fees range from $6 to
$10 depending on screen size (measured diagonally). The amount
of the recycling fee will be refunded if you choose to return

23. Out of Stock Items. It is never Logico's intension
to be out of stock on any item; in the event that such things
happen we will either upgrade you to an existent product when
ever possible, free of charge or we will refund your money.
It takes about 24 hours before such synchronization takes place
to reflect current available inventory. If we are out of stock,
will notify you of such events within 24 hours prior to shipping
and will require written consent of such upgrade approval via
email or fax, we will not accept verbal approval over the phone.
24. Technical Support. Logico Technology, Inc. does
not offer technical support on any of its hardware products.
Technical Support or How to Questions are to be directed to
the manufacturer.
25. Software/Demo Versions. LTI is not responsible for
demo software that is bundle with the manufacturer's hardware.
Demo versions are to entise the enduser/consumer to buy the
full/retaill version by the manufacturer and at no time is Logico
Technology, Inc., responsible for providing the full/retail
version. all hardware whether new of recertify comes sealed
from the manufacturer and contains the drivers and applications
to allow the proper function of the hardware. Demo versions
will not impact the performance of the hardware as it is an
additional application that is included in the bundling of the
hardware to entise the enduser/consumer to purchase the retail
verion.
